10. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees and court costs) arising from or related to:

THE ARBITRATION SHALL BE CONDUCTED UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) THEN IN EFFECT, WHICH ARE AVAILABLE AT WWW.ADR.ORG. THE ARBITRATION SHALL TAKE PLACE IN THE UNITED STATES, AND THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING ON THE PARTIES.

15.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND JET'S PIZZA AGREE, NO ARBITRATOR OR JUDGE MAY CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

15.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for Disputes within the scope of that court's jurisdiction. Either party may also seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
